Terms of Service

Terms of Use Agreement for ExTap Services

Introduction
This agreement, based on the principle of free will, is entered into between ExTap, referred to as ExTap and headquartered in Istanbul, and each user who intends to use the various services of the ExTap Company (ExTap.org) website and mobile application in any manner. Users are required to read all the provisions of this agreement before registering and register only if they accept them.

This document outlines the terms of use, rights, and obligations of the ExTap website and mobile application. The user declares that they have fully read, understood, and accepted the terms of the ExTap platform. Therefore, they waive any future or current claims of ignorance or other disputes.

The parties have declared their intentions under the following general and specific terms and final approval:

General Terms

Article 1: Definitions
1-1 Company: Referred to as ExTap and headquartered in Istanbul, the ExTap Company is referred to as the 'First Party' in this agreement.
1-2 ExTap Website: Accessible online via the domain ExTap.org, this website operates fully in compliance with the laws of the Republic of Turkey and includes these agreement terms for all users.
1-3 ExTap Application: The ExTap cryptocurrency buying and selling application operates on Android and iOS operating systems.
1-4 ExTap Market: The marketplace where users can buy and sell cryptocurrencies on the ExTap platform. All transactions are conducted between users, and ExTap does not act as a direct party.
1-5 User: The person visiting and voluntarily benefiting from the services of the ExTap website and/or application, referred to as the 'Second Party' in this agreement.
1-6 Agreement: The entire document consisting of the introduction, definitions, general and special terms, and final approval.
1-7 Electronic Commerce: Law No. 6563 on the Regulation of Electronic Commerce and relevant legal provisions.
1-8 Cryptocurrency: Financial instruments that can be converted into physical money, interest-free, and can be bought and sold. Includes digital cryptocurrencies like Bitcoin and can be used as a payment method on online platforms. Cryptocurrencies accepted on the ExTap platform are those listed and available for trade by users.
1-9 Payment: The transaction by which a user transfers money to a recipient in Turkish Lira or cryptocurrency for the purpose of buying cryptocurrencies.
1-10 Payment Method: The methods allowed for transferring money on the ExTap platform. Includes cryptocurrency transfers, bank transfers, credit card payments, etc.
1-11 Phishing: A fraud technique that uses fake websites or email addresses to obtain information such as usernames, passwords, and bank account details.
1-12 Wallet: An online platform with transfer features used for managing and storing cryptocurrencies.
1-13 Force Majeure: Events beyond the control of the parties, unavoidable, unforeseeable, and unpreventable. For example, natural disasters, war, strikes, epidemics, internet outages, power failures, etc.

Article 2: Subject of the Agreement
The subject of this agreement is for users to conduct cryptocurrency buying, selling, and conversion transactions on the ExTap internet platform under the terms and conditions stated in this agreement.

Article 3: Duration of the Agreement
This agreement is valid from the date of the user's membership, as long as it is not terminated by the First Party or there is no breach of platform rules by the Second Party.

Article 4: Description of Services
The services offered involve converting one cryptocurrency into another at a specific conversion rate and transaction fee, selling cryptocurrencies to users in exchange for Turkish Lira, or buying cryptocurrencies from users and paying them in Turkish Lira. ExTap provides these services on its platform under the terms of this agreement and as long as there are no legal barriers.

Additionally, ExTap provides users with the opportunity to trade with other users and benefit from legal and legitimate trading methods.

Terms and Responsibilities
The user is responsible for the security of their account information and password and accepts that the First Party is not liable for any negligence in protecting this information.
The user accepts that the First Party is not liable for any disruptions in services due to force majeure.
The user must fill out their address, email, and other required information in their profile completely before making any transactions. Otherwise, they bear the responsibility for any consequences.
The user accepts that notifications from the First Party will only be made through the email or phone number specified at the time of registration.
The user accepts that the First Party is not responsible for repurchasing cryptocurrencies and that the prices on the ExTap platform are determined by the users.
The user accepts that the First Party has no obligation to provide services related to cryptocurrencies that are not accepted or are invalid on the platform.

Special Terms

Article 5: Conditions and Commitments
The user is obligated to comply with all the articles stated in this agreement and take into account the following special conditions in their activities:
The user accepts that all cryptocurrency transactions and financial resources are legal and comply with the laws of the Republic of Turkey.
The user accepts that they are the legal owner of the accounts and funds used in cryptocurrency buying and selling.
The user accepts that if any provision of this agreement is declared invalid or illegal by competent authorities, the validity of the other provisions will not be affected.
The user accepts that they must be at least 18 years old to register on ExTap, verify their identity, and benefit from its services.
The user agrees not to share their account information with third parties and not to allow others to use their accounts. Otherwise, their account may be suspended, and they will be responsible for any resulting liabilities.
The user accepts that ExTap may modify its service terms due to changes in the laws of the Republic of Turkey, and these changes will be assumed to be accepted by the user.
The user must carefully read and approve the proforma invoice and contract presented before making a transaction. No commissions or other objections will be accepted after the transaction.
The user must only transact using bank accounts and cards registered and approved on the ExTap platform. Otherwise, ExTap is not responsible for any delays.
The user accepts that if they make transactions with someone else's bank cards or if a refund of funds is necessary, ExTap may inform the competent authorities if deemed necessary.
The user must carefully conduct their transactions and accept that transactions cannot be canceled in case of an error.
The user must only transfer money to wallet addresses and networks determined by ExTap. ExTap is not responsible for transfers made to the wrong address.
After the transaction is completed and transfers are made, ExTap's responsibility ends. The user is responsible for any problems arising from incorrect wallet addresses or erroneous information.
The user must provide all requested information correctly and completely during the identity verification process. This information will be kept confidential and not shared with third parties, except as required by law.
ExTap may request additional information and documents from users when necessary.
The user accepts the cryptocurrency conversion rates and fees determined by ExTap, and these details are presented to the user before the transaction.
ExTap reserves the right to stop or limit cryptocurrency trading at any time.
The user accepts that the cryptocurrency market carries high risks and that ExTap is not responsible for price fluctuations.
ExTap reserves the right to accept or reject identity verification procedures at its discretion.
The user is responsible for any tax liabilities arising from cryptocurrency transactions.
The user accepts that ExTap is subject to the laws of the Republic of Turkey and that its activities must comply with these laws.
The user agrees not to use the ExTap platform for illegal activities and accepts that their account may be suspended in such cases.

Other Provisions

Article 6: Force Majeure
In cases of force majeure (natural disasters, war, internet outages, etc.), the implementation of the agreement can be suspended. New terms can be determined by agreement between the parties. Otherwise, the agreement can be terminated by the First Party, and the user's payments will be refunded.

Article 7: Dispute Resolution
In cases where the First Party may be held liable or disputes arise from the interpretation of the agreement, the legal department of the ExTap Company will act as arbitrator, and its decision will be binding. The parties' contact information will be used based on the phone numbers provided during registration.
